Employment Authorization

  • Work Permits & Visas: Employers must ensure that all foreign workers hold valid work permits or visas that authorize their employment in Canada. Work permits must match the job description and employer listed on the visa.

  • Self-Audits: Regular internal audits help employers ensure they are following all regulations and maintaining accurate records. These audits help prevent non-compliance issues before government inspections occur.

Wages and Working Conditions

  • Fair Wages: Employers must provide wages and working conditions that meet or exceed the industry standards and are consistent with what was outlined in the worker’s LMIA application.
  • Employee Rights: Employers must ensure that foreign workers are provided the same workplace protections and benefits as Canadian employees. These protections include access to health and safety provisions, minimum wage, and other statutory entitlements under Canadian labor laws.

Employer Portal and Compliance Fees

  • Submission through Employer Portal: For LMIA-exempt workers under the International Mobility Program (IMP), employers are required to submit the offer of employment and pay the compliance fee through the Employer Portal before the worker applies for a work permit.
  • Compliance Fees: Employers are required to pay compliance fees for certain work permit applications under the IMP to support government enforcement activities.
